Terms of Service

These Terms govern use of Creator Collective (the “Platform”), including memberships, courses, marketplace, opportunities, community features, direct messaging, and related services.

1. Acceptance of Terms

By accessing or using Creator Collective (the “Platform”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Platform. These Terms apply to all users, including creators, members, buyers, sellers, applicants, employers, agencies, and administrators.

2. Account Registration & Eligibility

  • You must be at least 18 years old to create an account.
  • You must provide accurate, current, and complete information.
  • You are responsible for safeguarding your credentials and all activity on your account.
  • You may not share your account, or create multiple accounts to circumvent restrictions, limits, fees, or enforcement actions.

3. Memberships, Billing & Trials

3.1 Plans & benefits

The Platform may offer multiple membership plans and billing periods (for example, monthly and yearly). Plan names, benefits, and pricing are shown at checkout and in your dashboard and may change over time.

We may also offer legacy subscriptions or creator-specific subscription products (for example, “Legacy+”) with separate pricing and terms disclosed at checkout.

3.2 Billing, plan changes, and cancellation

  • Subscriptions are billed in advance on a recurring basis until canceled.
  • You can cancel from your account dashboard. Unless stated otherwise at the time you cancel, you retain access through the end of the current billing period.
  • If you upgrade or downgrade plans, we may apply prorations and/or credits depending on the plan and timing.
  • We do not provide refunds for partial billing periods except where required by law.
  • Subscription refunds after you have accessed the Platform are generally not available; see our Refunds & subscription billing policy for limited exceptions.

3.3 Payment failures and suspension

If a subscription payment fails, your membership may be suspended until payment is successfully completed or the subscription is reactivated.

3.4 Promotional access

From time to time, we may offer promotional pricing or access that may be time-limited and subject to additional terms disclosed at the time of the offer.

4. Platform Features & Usage

4.1 Courses, videos, and downloads

  • Course content and platform resources are for your personal, non-commercial use unless stated otherwise.
  • You may not redistribute, share, or resell platform content or downloads.
  • Access to certain content and features may require an active membership.

4.2 Discounts and partner offers

The Platform may include discounts or partner offers. Redemption requirements (such as membership requirements, expiration, and redemption limits) may apply and are shown where the offer is displayed.

5. Marketplace, Orders & Disputes

5.1 Our role: a platform, not a party to your sale

Creator Collective provides software and tools that help buyers and sellers find each other, communicate, and complete transactions. We are not a seller, buyer, broker, agent, insurer, escrow provider, or guarantor of any marketplace sale. When you buy or sell through the Platform, the transaction is a direct agreement between the buyer and the seller—not with Creator Collective.

Unless we expressly state otherwise in writing, we do not take title to items, control shipping, inspect goods, store inventory, or guarantee that any listing, user, or transaction is lawful, complete, or satisfactory. Our role is limited to operating the Platform and the connection and software that enable users to transact with one another.

5.2 Sales issues are handled between buyers and sellers

Because marketplace sales occur between users, you are responsible for resolving problems that arise from your transactions with other users, including but not limited to:

  • Items that are missing, never shipped, or delayed in delivery.
  • Items that arrive damaged, defective, broken, or not as described.
  • Disputes over quality, authenticity, completeness, or fitness for a particular purpose.
  • Refund requests, returns, exchanges, or payment disputes between users.
  • Fraud, misrepresentation, or failure to perform by another user.

You agree to communicate in good faith with the other party and to use any order or dispute tools we may offer only as a convenience—not as a substitute for your own obligations in the transaction.

5.3 No liability for user-to-user sales

To the fullest extent permitted by applicable law, Creator Collective will not be responsible or liable for any loss, damage, claim, or dispute arising from or related to a marketplace sale or transaction between users, regardless of whether payment was processed through the Platform, whether we facilitated messaging, or whether we reviewed or assisted with a dispute.

This limitation applies to any theory of liability—whether in contract, tort (including negligence), strict liability, or otherwise—and applies even if we have been advised of the possibility of such damages. Without limiting the foregoing, Creator Collective is not responsible for the actions or omissions of any buyer, seller, or other user; delivery failures or fulfillment outcomes; product quality or condition; or amounts owed, refunds due, or compensation requested between users.

You release Creator Collective and its affiliates, officers, directors, employees, and agents from any claims, demands, and damages arising from disputes with other users in connection with marketplace transactions, except where such release is prohibited by law.

5.4 Listings and purchasing

  • Sellers are responsible for accurate listings, lawful content, and timely delivery/fulfillment.
  • Buyers agree to transact in good faith and provide accurate information required for fulfillment.

5.5 Fees

Marketplace transactions may include platform fees. Certain plans (for example, No-Fees membership tiers) may waive platform fees, as shown at checkout or in your dashboard.

5.6 Cancellations, refunds, and dispute assistance

The Platform may, at our sole discretion, offer tools or processes to help users communicate about an order or dispute. Use of those tools is optional and does not make Creator Collective a party to the sale or responsible for its outcome.

Refunds, cancellations, or adjustments between users remain the responsibility of the buyer and seller unless we expressly agree otherwise in writing or are required by law. Where a cancellation flow, dispute process, or similar feature is available, we may request additional information or evidence before taking any action. Any action we choose to take is discretionary and does not create an ongoing obligation to resolve user-to-user sales disputes.

6. Opportunities, Contracts & Payments

6.1 Opportunities and third-party relationships

The Platform may allow users to post and apply to paid opportunities. We may also provide contract creation and signature tools and facilitate payments (such as deposits and final payments).

  • Opportunity listings must be legitimate and comply with applicable laws.
  • The Platform is not an employer, staffing agency, or party to contracts between users, unless explicitly stated.
  • Payments may be processed through our payment providers. In certain cases, funds may be transferred to sellers/contractors, subject to fees, disputes, and payment provider rules.

6.2 Completion timeline, dashboard confirmation, and deposits

If you accept or perform work under a paid opportunity for which an employer has funded a deposit or comparable upfront payment through the Platform, you agree that timely delivery and clear confirmation of completion are material obligations.

Unless a different deadline is expressly stated in the applicable opportunity listing or in a contract made available through the Platform, you must substantially complete the agreed deliverables and confirm completion using the “Complete” control (or similarly labeled completion action) in your user dashboard within thirty (30) calendar days after the engagement start date shown on the Platform. If no engagement start date is displayed, that thirty (30) day period begins on the date you accept the applicable engagement. Where the Platform provides a documented extension agreed between the parties through Platform tools, that documented date controls instead.

If those requirements are not satisfied within the applicable period, the employer may request cancellation, reversal, or refund of the employer's deposit or comparable upfront payment to the extent permitted by applicable law, these Terms, any separate Platform policies for disputes or releases, and the rules of our payment processors. You acknowledge and agree that Creator Collective may withhold, reverse, decline to disburse, or facilitate return of funds consistent with this Section and its policies, and that you will have no right to receive opportunity compensation, final payouts, or other amounts tied to that engagement from the employer or through the Platform for work that was not completed or not confirmed as complete as described above.

You agree not to assert any claim against Creator Collective solely because payouts were withheld, reversed, or not issued when we act in good faith in accordance with this Section; questions about scope, quality, or performance remain primarily between you and the other user, except where we elect to apply separate dispute or enforcement policies.

7. Community, Messaging & Safety

7.1 Community and message board

Respectful communication is required at all times. Harassment, hate, threats, spam, and scams are not allowed.

7.2 Direct messaging and attachments

The Platform includes direct messages and may allow users to upload media (such as images, video, audio, and files) within message threads. Only thread members should access thread content and attachments.

7.3 Reporting, blocking, and enforcement

You can report users and content, and you may be able to block other users. We may review reports and take action, including warnings, content removal, feature restrictions, or account suspension.

8. User Content & Intellectual Property

You retain ownership of content you submit to the Platform (“User Content”). By posting User Content, you grant Creator Collective a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your User Content as necessary to operate, improve, and promote the Platform.

Platform content, course materials, branding, and software are owned by Creator Collective or its licensors and are protected by intellectual property laws.

9. Prohibited Conduct

You agree not to:

  • Violate applicable laws or regulations.
  • Infringe intellectual property or privacy rights of others.
  • Upload malware, attempt to exploit vulnerabilities, or access systems without authorization.
  • Engage in fraud, impersonation, deceptive behavior, or payment abuse (including chargeback abuse).
  • Circumvent platform fees, limits, or security controls.
  • Harass, threaten, or abuse other users.

10. Suspension, Strikes & Termination

We may suspend, restrict, or terminate accounts for violations of these Terms, fraud, safety concerns, repeated violations, or payment issues. We may use a strike-based enforcement system for certain violations, and repeated strikes may result in profile removal or account termination.

11. Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. We do not guarantee uninterrupted or error-free service, or outcomes from marketplace transactions, opportunities, or user communications.

Without limiting Section 5, Creator Collective does not warrant or guarantee any marketplace listing, seller, buyer, item, shipment, or transaction. You use the marketplace at your own risk and are solely responsible for evaluating other users and the terms of any sale.

To the maximum extent permitted by law, Creator Collective is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including any marketplace sale or dispute between users.

12. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated through the Platform and/or via email. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
